PRIORITY

Taiwan is a member of WTO (World Trade Organization), thus the priority claim of patent or trademark from any.

Basic fee for up to 20 goods……… Official fee is US$95 approximately.

21 to 60 goods …………………….. Official fee is US$160 approximately.

More than 60 goods ……………… Official fee is US$285 approximately.

EXAMINATION

Generally, it takes 8-10 months for the examination procedure. Once the application being accepted by the

Examiner, a payment of registration fee shall be paid within 2 months from the date that received a written decision

TIPO (Taiwan Intellectual Property Office).

Adversely, the applicant might receive a Notice of Refusal which indicates examiner's concerns.

Examiner has some concerns in designated goods of the application. The applicant should submit a written response to clarify examiner's doubt.

☆Preliminary Rejection

Similar registered mark might be found by the examiner. The applicant should submit a written response to emphasize the difference between cited marks and present application.

A publication will not be made if the foregoing fee is not paid within 2 months from the date that received a written

decision from TIPO.

When the application being accepted by the Examiner, a payment of registration fee shall be paid within 2 months

from the date that received a written decision from TIPO.

Once fulfill above-mentioned details, the trademark will be published in the Trademark Gazette.

A trademark application shall be granted upon the date of publication and a trademark certificate shall be issued

thereto.
